Terms of Use
Effective Date: July 17, 2026
Last Updated: July 17, 2026
Introduction
These Terms of Use explain the rules for using websites, products, software, publications, communications, and services owned and operated by Emerald Arbor, LLC.
By using a covered website, product, or service, you agree to these Terms and any product-specific terms presented to you. If you do not agree, do not use the applicable offering.
Where an account, purchase, subscription, personalization, or submission flow presents an agreement checkbox, button, or similar affirmative action, you agree by completing that action. We may retain records showing the version presented, date and time, transaction or account identifier, and affirmative action taken.
Scope
These Terms apply to Emerald Arbor, LLC and the products and services identified on our Covered Products & Services page, unless a product publishes supplemental or replacement terms.
Names used for individual websites, products, publications, software, or services identify offerings owned and operated by Emerald Arbor, LLC. They do not identify separate legal entities unless expressly stated otherwise.
Eligibility
You must have the legal capacity to agree to these Terms.
When you use a covered product or service on behalf of an organization, you represent that you have authority to bind that organization.
Accounts
Some products or services may require an account.
You are responsible for providing accurate information, maintaining the confidentiality of your credentials, and promptly notifying us of suspected unauthorized use.
We may suspend or restrict an account when reasonably necessary to protect customers, systems, providers, or legal rights.
Acceptable Use
You may use covered websites, products, and services only for lawful purposes and as intended.
You may not:
- Violate applicable law or another person’s rights
- Attempt unauthorized access
- Interfere with security or operation
- Upload malware or harmful code
- Impersonate another person
- Use automated means to scrape or extract content without permission
- Abuse communications, support, or product features
- Use content or services for unlawful, deceptive, harmful, or infringing activity
Intellectual Property
Covered websites, publications, text, audio, graphics, logos, software, tools, downloads, and other original materials are owned by Emerald Arbor or used with permission.
They are protected by copyright, trademark, and other applicable laws.
Purchasing or accessing a product does not transfer ownership of intellectual property.
License and Personal Use
Unless a product states otherwise, a purchase grants a personal, limited, non-exclusive, non-transferable license to use the product for its intended purpose.
You may download, save, or print a purchased digital product for personal use and may share it privately within your immediate household when appropriate.
You may not reproduce, republish, distribute, resell, sublicense, publicly display, publicly perform, or commercially exploit our content without written permission.
Products and Descriptions
Product descriptions, features, prices, delivery methods, subscription terms, and product-specific conditions are presented before purchase.
We may update future offerings, prices, descriptions, features, or availability. Changes do not alter a completed purchase unless required by law or expressly agreed.
Personalized Products
Some products may be created using names, preferences, questionnaire responses, recordings, or other information you provide.
You are responsible for providing accurate information and for having an appropriate basis to submit information about another person.
Provide only information reasonably necessary for the requested product. Do not submit unnecessary medical, clinical, financial, identification, or other highly sensitive information unless a product specifically requests it and provides an appropriate notice.
We will make reasonable efforts to produce the requested personalization, but personalized content may not reflect every circumstance or preference.
Payments and Merchant of Record
Certain purchases may be completed through a Merchant of Record or other payment provider.
Paddle currently serves as the Merchant of Record for many Emerald Arbor purchases.
Payment processing, taxes, invoicing, currency, billing, and related matters are explained in our Payment Processing & Billing Policy.
Subscriptions
Some services may renew automatically.
Immediately before enrollment, the applicable checkout or order flow will disclose the price, billing interval, automatic-renewal terms, trial conversion terms, cancellation method, material restrictions, and product-specific refund terms.
Customers should receive a confirmation they can retain.
Cancellation generally stops future renewals. Refund eligibility is governed by the applicable product-specific offer, our Refund Policy, and mandatory law.
Refunds
Refund eligibility and procedures are governed by our Refund Policy, the terms presented for the specific product, and applicable law.
Communications
We may send transactional, administrative, support, account, security, educational, or marketing communications as permitted by law and consistent with your choices.
SMS enrollment, consent records, message controls, and opt-out procedures are governed by our SMS Terms & Consent.
AI-Assisted Features
Some products or services may use AI to generate or assist with content, recommendations, summaries, voice interactions, personalization, search, or automation.
AI-assisted output may be inaccurate, incomplete, outdated, unexpected, or not unique. You are responsible for evaluating output before relying on it.
AI-assisted output is not a substitute for qualified professional advice or human judgment.
Unless a product provides a specific legally compliant notice, Emerald Arbor does not use AI as the sole basis for decisions that produce legal or similarly significant effects concerning employment, credit, housing, insurance, education, healthcare access, or essential services.
Additional information is available on our AI Transparency page and in our Privacy Policy.
User Content
When a feature allows you to submit content, you retain any rights you lawfully hold in that content.
You grant Emerald Arbor a limited right to host, process, reproduce, transmit, and use the content as reasonably necessary to provide, secure, support, and improve the requested product or service.
You represent that you have the right to submit the content and that doing so does not violate law or another person’s rights.
Educational Information
Unless expressly stated otherwise, Emerald Arbor content is provided for general educational and informational purposes.
It is not medical, legal, financial, accounting, psychological, or other professional advice.
Seek qualified professional advice when appropriate for your circumstances.
Availability and Changes
We work to maintain covered products and services but do not guarantee uninterrupted or error-free availability.
We may maintain, update, replace, suspend, limit, or discontinue a product, feature, or service when reasonably necessary.
Third-Party Services
Covered offerings may link to or integrate with independent providers.
Emerald Arbor does not control their content, availability, privacy practices, security, or independent terms.
Additional information is available on our Third-Party Services & Providers page.
Consumer Rights
Nothing in these Terms excludes or limits mandatory rights that cannot legally be waived, including applicable rights concerning digital content, services, conformity, cancellation, withdrawal, repair, replacement, price reduction, or refund.
Product-specific checkout terms may provide additional information for customers in particular jurisdictions.
Disclaimer of Warranties
To the fullest extent permitted by law, covered websites, products, and services are provided “as is” and “as available.”
We do not guarantee that every offering will be uninterrupted, error-free, suitable for every purpose, or meet every individual expectation.
Limitation of Liability
To the fullest extent permitted by law, Emerald Arbor, LLC and its owners, employees, contractors, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to a covered website, product, or service.
To the fullest extent permitted by law, Emerald Arbor’s total liability relating to a purchase or claim will not exceed the amount paid for the specific product or service giving rise to the claim.
These limitations do not apply to liability that cannot legally be limited, including liability arising from fraud, willful misconduct, or other conduct for which applicable law does not permit exclusion or limitation.
Indemnification
To the extent permitted by law, you agree to indemnify and hold Emerald Arbor harmless from third-party claims, losses, liabilities, and reasonable expenses caused by your unlawful conduct, fraud, knowing infringement, material violation of these Terms, or submission of content you did not have the right to provide.
