Emerald Arbor, LLC (“Emerald Arbor,” “we,” “our,” or “us”) owns and operates websites, products, and services designed to provide digital content, software, communications, and related online experiences.

This Privacy Policy explains what personal information we collect, how we use it, when we disclose it, how long we retain it, and the choices and rights that may be available to you.

Scope

This policy applies to Emerald Arbor, LLC and the products and services identified on our Covered Products & Services page, unless a product publishes supplemental or replacement terms.

Names used for individual websites, products, publications, software, or services identify offerings owned and operated by Emerald Arbor, LLC. They do not identify separate legal entities unless expressly stated otherwise.

Our Role

Emerald Arbor, LLC is the controller of personal information when we determine why and how that information is processed.

An independent provider may act as a separate controller for functions it determines independently, such as payment processing performed in its role as Merchant of Record. Other providers may process information on our behalf.

Information We Collect

We may collect information you provide directly, including your name, email address, telephone number, mailing or billing address, purchase information, account information, form responses, preferences, support requests, newsletter selections, and information submitted to personalize or deliver a requested product or service.

Some personalized products may use limited information you provide to create, deliver, or support the requested product. Unless a specific product clearly states otherwise, Emerald Arbor does not provide medical or healthcare services and does not request medical records, diagnostic test results, treatment records, prescription information, or detailed clinical information.

The subject of a product or purchase may relate to personal experiences, relationships, accessibility, wellness, or other sensitive topics. We do not use that subject matter to diagnose individuals, create medical profiles, infer additional health conditions, or make decisions about anyone’s health.

Please provide only the information requested and reasonably necessary to receive the applicable product or service. Avoid submitting unnecessary medical, clinical, or highly sensitive information about yourself or another person.

We may collect information automatically when you use a covered website, product, or service. This may include your IP address, browser and device type, operating system, referring page, pages viewed, links selected, approximate location, access times, identifiers, cookie information, and other usage information.

When you make a purchase, the applicable payment provider may collect payment-card or other payment-account information. Emerald Arbor generally does not receive or store complete payment-card numbers.

When you use SMS, voice, or AI-assisted features, we may collect information related to those interactions, including telephone numbers, recordings, transcripts, message content, form answers, preferences, prompts, responses, consent records, delivery information, and opt-in or opt-out activity.

Sources of Information

We may receive information:

  • Directly from you
  • From a purchaser who provides limited information for personalization or delivery
  • From another person who contacts us on your behalf
  • From payment, communications, hosting, analytics, security, or other providers
  • From devices and browsers when you use a covered website or service
  • From publicly available sources when reasonably necessary for security, fraud prevention, or business administration

When a purchaser provides another person’s name or limited personal circumstances for personalization, we normally use that information only to create, deliver, support, or secure the requested product. We do not contact the other person merely because their information appears in a personalized product unless separately authorized.

Some information is required to complete a purchase, deliver a product, create an account, provide requested personalization, comply with law, or protect a transaction.

Other information is optional.

When required information is not provided, we may be unable to complete the transaction, provide the requested product or feature, verify a request, or satisfy a legal obligation. Where practical, the collection point will identify required fields.

Where we rely on legitimate interests, those interests may include operating and improving our services, protecting customers and systems, preventing fraud and abuse, responding to inquiries, maintaining records, and understanding product performance. We consider the nature of the information, the expected use, and the possible effect on individuals before relying on this basis.

You may withdraw consent where processing depends on consent. Withdrawal does not affect processing that was lawful before consent was withdrawn.

Email, SMS, and Voice Communications

We may send communications when you request information, make a purchase, use a service, create an account, subscribe, or separately consent to receive them.

Marketing emails include a working unsubscribe method. Commercial email sent by Emerald Arbor is intended to use accurate sender and subject information, identify Emerald Arbor as appropriate, include a valid postal address, and honor valid unsubscribe requests within the period required by applicable law.

Marketing SMS may be stopped by replying STOP or through another reasonable revocation method recognized by applicable law. Transactional, administrative, security, or service-related communications may continue when permitted or required.

When a voice interaction is recorded or transcribed, we provide an appropriate notice before or at the beginning of the interaction and obtain consent when required by applicable law.

Notices at Collection

Additional notices may appear at or before specific collection points, such as checkout, account creation, newsletter enrollment, personalization forms, SMS enrollment, voice interactions, or other product features.

Those notices supplement this Privacy Policy and may identify the particular categories collected, purposes, retention criteria, and choices associated with that interaction.

Cookies and Similar Technologies

We may use cookies, pixels, tags, scripts, local storage, software development kits, and similar technologies for essential functions, preferences, security, analytics, attribution, and marketing.

Payments

Purchases may be processed by an independent payment provider or Merchant of Record.

Paddle currently serves as the Merchant of Record for many Emerald Arbor purchases. Payment providers may process billing, transaction, tax, currency, receipt, invoice, refund, and fraud-prevention information.

How We Disclose Information

We may disclose personal information to providers that support functions such as:

Sale, Sharing, and Targeted Advertising

Depending on the technologies used by an individual product and the law that applies where you live, certain disclosures of identifiers or usage information for cross-context behavioral advertising or targeted advertising may be treated as a “sale” or “sharing” of personal information.

Emerald Arbor does not sell personal information for money.

Where required, you may opt out of activities legally defined as sale, sharing, or targeted advertising. Instructions are available on our Data Rights page and, where provided, through applicable cookie controls.

Artificial Intelligence

Some products and features may use AI providers to process information submitted to the feature or information needed to provide the requested experience.

AI-assisted output may be generated from prompts, form answers, preferences, recordings, transcripts, or other information associated with the feature.

Whether an AI provider retains submitted information or uses it to improve its services depends on the provider, product configuration, contract, and applicable notice. Emerald Arbor will not represent that information is excluded from provider training unless the relevant configuration or agreement supports that statement.

We seek to minimize unnecessary personal information sent to AI providers and may provide product-specific information when an AI feature materially differs from the general practices described here.

International Processing and Transfers

Emerald Arbor is based in the United States. Personal information may be processed in the United States and other countries where we or our providers operate.

Where applicable law requires a transfer safeguard, we take reasonable steps to use an available lawful transfer mechanism or another recognized basis for the transfer.

You may contact privacy@emeraldarborllc.com to request additional information about safeguards applicable to a particular transfer, subject to legal and confidentiality limitations.

Data Retention

We retain personal information only for as long as reasonably necessary for the purpose for which it was collected and for related legal, security, accounting, customer-support, and compliance needs.

Retention depends on the type of information and the product involved. Criteria may include:

  • Account records: while the account remains active and for a reasonable period after closure
  • Purchase, tax, and accounting records: for the period required by applicable financial and tax law
  • Product-delivery and personalization information: for the period needed to create, deliver, support, or reproduce the requested product, as explained by the applicable product where appropriate
  • Customer-support records: for the period needed to resolve and document the request
  • Marketing-consent and suppression records: while subscribed and afterward as reasonably necessary to prove or honor the customer’s choice
  • SMS consent, HELP, delivery, and opt-out records: as described in our SMS Terms & Consent
  • Voice recordings and transcripts: according to the purpose of the interaction, applicable product practices, and legal or compliance needs
  • Security and technical logs: for a reasonable period needed to protect services and investigate incidents

We may retain limited information after a deletion request when permitted or required to honor an opt-out, prevent fraud, complete a transaction, comply with law, or establish, exercise, or defend legal rights.

Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.

No online system, transmission method, or storage system can be guaranteed completely secure.

Children’s Privacy

Our covered products and services are not directed to children under 13, and we do not knowingly collect personal information from children under 13 without legally valid authorization.

Before launching a product directed to children or likely to collect information from children, Emerald Arbor will conduct a product-specific privacy review and provide any required notice, age screening, parental permission, or consent process.

Emerald Arbor will not knowingly sell or share personal information of a minor in circumstances requiring affirmative authorization without obtaining the authorization required by applicable law.

Residents of the European Economic Area may contact the supervisory authority in their country of residence, work, or the location of the alleged infringement. A covered website, product, or service may link to an independent third-party website or service.

This Privacy Policy does not govern the independent privacy practices of those third parties. We encourage you to review their policies before providing personal information.

Product-Specific Terms

Product-specific terms supplement this framework unless they expressly state that they replace a particular provision.

If product-specific terms conflict with this Privacy Policy, the product-specific terms control only for that product or service and only to the extent of the conflict.

Changes to This Policy

We may update this policy to reflect changes in our products, services, providers, legal obligations, or business practices.

When appropriate, we will revise the Last Updated date shown at the beginning of this page.
