Introduction

Text messaging should be expected, useful, and easy to control.

These SMS Terms & Consent explain how Emerald Arbor, LLC obtains consent, sends messages, maintains transactional consent records, and processes opt-out and help requests.

Scope

These terms apply to SMS programs associated with products and services owned and operated by Emerald Arbor, LLC.

A specific SMS program may provide additional terms at enrollment. Those terms supplement this policy unless they expressly replace a particular provision.

Separate Consent

Purchasing a product or service does not automatically enroll you in marketing SMS.

Where consent is required, SMS consent is requested separately and applies to the program and message purposes described at enrollment.

Consent to marketing SMS is not a condition of purchase unless SMS is necessary to provide the specific service you request.

Ways You May Enroll

Depending on the program, you may enroll through:

  • A website form
  • A checkbox or button
  • A checkout option presented separately from purchase
  • A keyword sent by text
  • A customer-support interaction
  • A telephone conversation
  • A voice or AI-assisted interaction
  • Another method that clearly explains the messages you are agreeing to receive

Voice-Based Enrollment

You may provide verbal SMS consent during a telephone or voice interaction, including an interaction with an AI voice agent or virtual assistant.

The enrollment process should identify Emerald Arbor or the applicable product, describe the expected messages, disclose that message frequency may vary, state that message and data rates may apply, explain how to revoke consent, and obtain an affirmative indication of consent.

When an interaction is recorded or transcribed, we provide an appropriate notice before or at the beginning of the interaction and obtain consent when required by applicable law.

Where required or appropriate, a confirmation message may be sent after enrollment.

Marketing Consent

Where prior express written consent is required for marketing messages sent using automated technology, the enrollment record will identify Emerald Arbor or the applicable product, the telephone number, the categories of marketing messages, the use of automated technology where applicable, the fact that consent is not a condition of purchase, and the available method for revoking consent.

Transactional or administrative messages may be governed by a different consent standard according to the purpose of the message and applicable law.

Types of Messages

Depending on the program and your relationship with Emerald Arbor, messages may include:

  • Requested links or information
  • Educational content
  • Product updates
  • Promotions and offers
  • Order confirmations
  • Delivery notices
  • Receipts
  • Account notifications
  • Reminders
  • Service announcements
  • Customer support
  • Security or verification messages
  • Other messages described when you enroll

Some messages are transactional or administrative. Marketing messages are sent only with the consent required by applicable law.

Message Frequency

Message frequency varies according to the program, purchases, subscriptions, preferences, and interactions.

Any recurring program may provide a more specific frequency disclosure when you enroll.

Message and Data Rates

Message and data rates may apply according to your mobile carrier and plan.

Emerald Arbor does not charge a separate SMS fee unless clearly disclosed for a specific service.

Delivery

Wireless carriers and communication providers are not responsible for delayed or undelivered messages.

Delivery may be affected by network availability, device settings, carrier restrictions, telephone-number status, and other factors outside Emerald Arbor’s control.

Opting Out

You may revoke consent by replying STOP to an applicable message or by using another reasonable method recognized by applicable law.

A valid revocation may also be submitted through email, telephone, or customer support when that method clearly communicates that you no longer wish to receive the applicable messages.

We will honor valid revocation requests within the period required by law.

After a revocation request, we may send one final confirmation message. You will not receive further messages covered by the revocation unless you enroll again or a legally permitted exception applies.

The scope of a revocation will be determined by the request, the enrollment, and applicable law. A revocation may apply more broadly than one program when the law requires that result.

Marketing consent is not automatically transferred between unrelated products or SMS programs merely because Emerald Arbor owns and operates them.

Transactional and Administrative Messages

Where permitted by law, Emerald Arbor may send non-marketing messages reasonably necessary to:

  • Complete a requested transaction
  • Deliver a purchased product
  • Respond to a support request
  • Provide account or security information
  • Confirm enrollment or opt-out
  • Provide a requested service
  • Comply with law

Where consent is legally required for a transactional or administrative message, we will obtain the required consent.

Re-enrollment

After opting out, you may enroll again through a valid enrollment method and a new affirmative action.

A new enrollment does not erase prior consent or opt-out records.

Consent Records

Emerald Arbor may create and retain transactional records documenting SMS enrollment, consent, delivery, help, and opt-out activity.

Depending on the enrollment method and program, records may include:

  • Mobile telephone number
  • Date and time
  • Enrollment source
  • Website, form, checkbox, keyword, or workflow used
  • IP address or device information
  • Consent language displayed or spoken
  • Affirmative action taken
  • Program name
  • Message categories
  • Confirmation messages
  • Message logs
  • Delivery records
  • HELP requests
  • STOP and other opt-out requests
  • Opt-out confirmation
  • Re-enrollment records
  • Customer-support notes
  • Voice recordings
  • Call metadata
  • AI-agent or virtual-assistant logs
  • Transcripts
  • Timestamps
  • Other information reasonably necessary to demonstrate consent or compliance

These records may be retained for as long as reasonably necessary to document consent, honor opt-outs, resolve disputes, respond to carriers or governing bodies, prevent unwanted messages, and comply with legal or messaging requirements.

Your Responsibility

By enrolling, you confirm that you are the subscriber or customary user of the mobile number provided or that you have permission to receive messages at that number.

Notify us if you change or relinquish the number.

Privacy

Mobile numbers, recordings, transcripts, message content, and consent records are handled as described in our Privacy Policy.

Emerald Arbor does not sell SMS consent.

We do not share SMS consent with third parties for their own independent marketing.

We may disclose information to communications providers and other service providers as needed to operate the program, document consent, deliver messages, process opt-outs, maintain security, or comply with law.

Changes to a Program or These Terms

Program details may change. Material changes affecting consent or the nature of recurring messages may require additional notice or consent.

We may update these terms to reflect changes in programs, providers, legal obligations, or messaging requirements.

When appropriate, we will revise the Last Updated date shown at the beginning of this page.
